Independent rankings exist for the upper end of the market. International Tax Review publishes annual tiers for Indian tax and transfer pricing firms, and the legal directories rank tax law firms. They are useful for large mandates. They do not cover most boutiques or local practices, and absence from them says nothing about quality.

Ten questions to ask before you appoint anyone

  2. What have you handled in the last two years that is close to my issue? Describe it without naming the client.

  4. What will you need from me, and by when?
  5. What are the statutory deadlines on this matter?
  6. For cross-border work: who covers the other country, and do they sit in your firm?
  7. For disputes: which forums do you appear in yourselves, and when do you bring in counsel?
  8. What is the fee, what does it cover, and what would cause it to change?
  9. How will you keep me informed, and how fast do you respond?
  10. Do you have any conflict of interest?

A good adviser answers the third question with specifics, including what could go wrong. Be cautious of anyone who promises an outcome.

Fees, in broad terms

Indian chartered accountants are not permitted to charge fees contingent on results in most kinds of work, so expect fixed or time-based fees. Routine compliance is priced per filing or per month. Advisory opinions and structuring are usually fixed fees agreed in advance. Litigation is priced per stage: reply, first appeal, Tribunal. Large-firm partner rates are several times those of boutiques and local practices. The cheapest quote is rarely the cheapest outcome in tax, because the cost of a wrong position is interest, penalty and years of dispute.
